1. Acceptance of Terms

By accessing and using PromptEasy ("Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Service.

2. Description of Service

PromptEasy provides an AI-powered platform for creating digital avatars, AI characters, and talking head videos. Our services include:

  • AI avatar/character generation
  • Talking head video creation
  • Voice synthesis and cloning
  • Scene and background generation
  • AI twin creation

3. User Accounts

To use certain features of the Service, you must:

  • Create an account with accurate information
  • Be at least 18 years old
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Purchases and Payments

4.1 Pricing

All purchases are one-time payments. Prices are displayed in Indian Rupees (INR) and include applicable taxes. We reserve the right to modify pricing at any time.

4.2 Credits

Purchased credits (avatars and videos) do not expire and can be used at any time. Credits are non-transferable between accounts.

4.3 Refunds

Due to the digital nature of our services, all purchases are final. Refunds may be considered on a case-by-case basis for technical issues that prevent service delivery. Contact support@prompteasy.in for refund requests.

5. Acceptable Use Policy

You agree NOT to use the Service to:

  • Create content that impersonates real individuals without their consent
  • Generate illegal, harmful, or offensive content
  • Create deepfakes or misleading media intended to deceive
  • Produce content involving minors
  • Generate hate speech, harassment, or discriminatory content
  • Create content that infringes on intellectual property rights
  • Distribute spam or malicious content
  • Attempt to reverse engineer or exploit our systems
  • Use automated systems to access the Service without permission

6. Content Ownership

6.1 Your Content

You retain ownership of the content you create using our Service. By using our Service, you grant us a non-exclusive license to store, process, and display your content as necessary to provide the Service.

6.2 Generated Content

AI-generated avatars, videos, and images created through our Service are yours to use for personal and commercial purposes, subject to our Acceptable Use Policy.

6.3 Our Content

All other content on the Service, including but not limited to text, graphics, logos, and software, is owned by PromptEasy and protected by intellectual property laws.

7. AI-Generated Content Disclaimer

Content generated by our AI systems may not always be accurate, appropriate, or suitable for your intended purpose. You are solely responsible for reviewing and approving any content before use. We do not guarantee that AI-generated content will be free from errors or biases.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time without notice.

9. Limitation of Liability

To the maximum extent permitted by law, PromptEasy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data
  • Business interruption
  • Any damages arising from your use of the Service

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless PromptEasy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
